Rules and Regulations

  1. Raffle Sponsor. This raffle is operated and sponsored by Invest in Kids Foundation (the "Raffle Sponsor").

  2. Tickets. There are 10,500 tickets available. Tickets are $20 each or 3 tickets for $50. The cost of a ticket is not tax deductible. Tickets will be sold while quantities last on a first come, first served basis.

  3. Eligibility. Tickets will be sold only in Ontario and only to individuals at least 18 years of age who are residents of Canada (excluding Qu�bec), except for directors and employees of the Raffle Sponsor or directors and officers of the Prize Sponsors (as defined in section 5 below), or the members of the immediate families of any such individuals living in the same household. Each ticket is eligible to win only one prize.

  4. Validation. Only tickets that have been validated as payment received will be entered into the draw. In the event a cheque is returned to the Raffle Sponsor by a financial institution, the ticket price must be paid in full before the ticket will be validated. All valid tickets are eligible for the draw in accordance with these rules.

  5. Prizes. The prizes to be awarded are:

    1. One 2002 Buick Rendezvous courtesy of Addison on Bay that has an approximate retail value of $32,000. Winner must take delivery of the vehicle within 60 days of notification. Delivery, freight and preparation charges, GST, and provincial taxes are included, but any other expenses, including vehicle license, gas and insurance will be the responsibility of the winner. Winner may not have a choice of the colour of either the exterior or interior of the vehicle. Winner must accept delivery of the vehicle "as is". The only warranties which apply are those of the manufacturer.
    2. One continuous six-nights of accommodation at Polar Peak Lodge #5 at Fernie Ski Resort in Fernie, Alberta, courtesy of R. D. Skelton, approximate retail value $3,000. Winner will be responsible for own travel to and from the condominium, all food, drink, ski lift tickets and any other expenses. Winner will be required to give 30 days notice of travel plans. The condominium is subject to availability and blackout dates (including December 20, 2002 – January 8, 2021 and March 8 to 23, 2003). Condo arrangements, once made, are final and cannot be changed. The condo must be booked and used by April 15, 2003.

    5. Collectively, Addison on Bay, R. D. Skelton, TAG HEUER CANADA, Jeremy Bortz and France Concepts are referred to as the "Prize Sponsors".

      The total value of the prize pool is $40,000. No cash or prize substitution is allowed except at the discretion of the Raffle Sponsor. If a prize cannot be awarded due to circumstances beyond the control of the Raffle Sponsor, a substitute prize of equal or greater value will be awarded. Prizes are not transferable. Prizes may not be exactly as described and may be different from any depictions of the prizes that are set out in any advertising or promotion related to this raffle. Prizes are tax free to Canadian residents.

  6. Acceptance of Prizes. The prizes must be accepted as awarded and must be claimed by one year after the Raffle Time (as defined below). The winners of the prizes will be required to sign a declaration and release confirming compliance with the rules and acceptance of the prize as awarded. Upgrades are permissible by winners but at their own expense.

  7. Chances of Winning. The chances of winning the prize depend on the number of tickets sold. If all tickets are sold, the chances of winning one of the prizes will be 1 in 2,625. All enquiries on the "chances of winning" are to be made to the Raffle Sponsor prior to the purchase of the ticket(s) at: Invest in Kids Foundation, tel: 416-977-1222 or fax: 416-977-9655.

  8. Raffle Closing Time and Date. Tickets must be purchased before 9:00 p.m. on April 18, 2020 (the "Raffle Closing Time").

  9. Time and Location of Draw. A random draw for the prizes will take place on April 18, 2020 at approximately 9:00 p.m. (the "Raffle Time") at Battle of the Brains� 2002 at the Guvernment Night Club located at 132 Queens Quay East in Toronto, Ontario. Winning tickets will be hand drawn from all of the eligible entries received on or before the Raffle Closing Time.

  10. Notification to Winners. All winners will be notified by phone and/or mail with instructions on how to redeem their prize.

  11. Publicity. By entering the raffle, each entrant consents to the use of his or her name and/or likeness, city of residence and ticket number in any publicity related to the raffle carried out by the Raffle Sponsor or Prize Sponsors without compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, including the Internet, unless prohibited by law. The winners will be published on the Invest in Kids website by April 25, 2002.

  12. Collection of Personal Information. By entering the raffle, entrants consent to the Raffle Sponsor’s collection, use, disclosure and sale of personal information to any third party with whom the Raffle Sponsor shares such information for the purposes of fundraising, and the marketing and administration of this raffle.

  13. Limitation of Liability and Indemnity. By purchasing a ticket and entering this raffle, entrants agree to release (except as set forth below), indemnify and hold harmless the Raffle Sponsor, the Prize Sponsors, any of their respective parents, affiliates and subsidiaries, advertising, promotional, publicity, production and judging agencies, directors, officers, employees and agents from any claim, loss, expense (including legal fees) or other liability, including liability for personal injury, arising from participation in the raffle or the awarding, acceptance, use or misuse of any of the prizes. The liability of the Raffle Sponsor is limited to the price of the ticket.

  14. Cancellation of Raffle. Subject to the charitable gaming licensing requirements of the City of Toronto and the Alcohol and Gaming Commission of Ontario, the Raffle Sponsor reserves the right to cancel or modify the raffle and/or the prizes if, at its sole discretion, it determines that for any reason the raffle is not capable of running as originally planned or if there is fraud, technical failure, printing or distribution errors, or any other causes or occurrences which have compromised the fairness or integrity of the raffle. If, as a result of an error relating to the entry process, drawing or any other aspect of the raffle, there are more potential winners of the prizes than contemplated in the raffle rules, there will be a random draw amongst all eligible prize claimants after the Raffle Time to award the prizes.

  15. Incomplete entries. Any entry which is incomplete may be disqualified and any entry which has been obtained through fraudulent or illicit means or which does not otherwise satisfy any condition of the raffle rules will be disqualified. The Raffle Sponsor takes no responsibility for tickets disqualified it being understood that each entrant shall take all necessary measures to avoid same and shall assume all the consequences in this respect.

  16. License Number. This raffle is operated under Toronto Lottery license # M177836.

  17. Charitable Registration. The Raffle Sponsor’s charitable registration number is 89385 3283 RR0001.
